Chinese Name & Address

Article 8 of the Regulations for the Implementation of the Chinese Trademark Law requires that "The Chinese language shall be used in applying for trademark registration or handling other trademark matters´".This includes the applicant¨s name and address.

Furthermore, it is obviously advantageous for the applicant to have a consistently translated, easily recognizable and natural sounding-Chinese name, which will endow the applicant with increased recognition and stature in the eyes of the Chinese public.  Thus, for both commercial and legal reasons, it is important for a foreign applicant to have a fixed Chinese name and address.

1.   Translation

  When the applicant's name or address has a fixed meaning in Chinese, we always adopt their commonly used translations. For example, for ^Bank of America ̄ we would use the Chinese words for ^Bank ̄ and ^America ̄,

2.   Transliteration

If the applicant's name or address is a coined word that does not have any meaning in Chinese, we shall make a suggestion based on the phonetic spelling and give the most proper and acceptable Chinese name, which can be easily recognized by the Chinese consumers. In choosing the transliteration we will also be careful to avoid using Chinese characters that have a negative meaning.
