Necessary Documents & information for TM Affairs:
A) Filing:
a) 1 copy of dully executed Power of Attorney ;
b) Trademark samples ( 6 copies for black & white or
6 colored copies and 4 black-and-white copies where
protection for color is claimed; size of the samples:
5x5cm --- 10x10cm);
c) A copy of the Business License (for domestic
applicant).
* Valid certified document to authorize to manufacture
or operate issued by local authority concerned is
required for the application in respect of
pharmaceutical product for human use, infant food or
medical nutriments by foreign applicant.
* Valid certified document issued by competent authority
concerned is required for the application in respect of
pharmaceutical product, cigarettes, newspaper or
magazines.
* A notarized statement of Authorization duly executed
by relevant right holder is required for the application
in respect of human portrait.
B) Claim to Priority:
Priority documents (certified copy)
* Date of filing and the application number issued by
relevant authority in the country of basic application
shall be indicated in the document; and
* Right of priority shall be claimed with the submission
of the application.
C) Review:
1 copy of Power of Attorney (Original copy
is needed)
D) Opposition:
1 copy of Power of Attorney
E) Dispute:
1 copy of Power of Attorney
(Original copy is needed)
F) Cancellation of improperly registered trademark:
1 copy Power of Attorney
(Original copy is needed)
G) Renewal:
a) 1 copy of Power of Attorney;
b) 1 copy of duplicate of Business License (for
domestic registrant);
H) Modification of Registrant¡¯s Name/address:
a) 1 copy of Power of Attorney;
b) 1 copy of duplicate of Business License (for
domestic registrant);
Certified document for title or name modification (2
copies of certified document provided by the AIC at
county level or higher, or issued the competent
authority concerned is required for domestic enterprise;
the certified document is required also for the
modification of English name by the foreign applicant).
I) Recordal of Trademark License Agreement:
a) 1 copy of Power of Attorney duly signed by
licensor;
b) 1 copy of Application Form;
c) 1 copy of duplicate of Trademark License Agreement
;(original or certified copy)
J) Assignment:
a) 1 copy of Power of Attorney duly signed by the
assignee;
b) 1 copy of Application Form duly signed by both the
assignor and the assignee(2 copies);
c) 1 copy of duplicate of Business License where the
assignee is domestic applicant;
K) Overseas Filing:
* International Registration through Madrid Agreement
and Protocols:
a) 1 copy of Power of Attorney;
b) Trademark sample;
c) Filing/Registration Information
Note: The applicant may be domestic (including Hong
Kong, Macao and Taiwan) enterprise, institution, or
individual industrialists & businessmen.
* Trademark Application in a single country
a) 1 copy of Power of Attorney;
b) 25 copies of Trademark sample.
Note: Requirements for trademark application differ from
country to country under different legal systems. Aside
from the above-referenced documents, Power of Attorney
appointing local agent, notarized or certified Business
License, Power of Attorney or Certificate of Trademark
Registration may be requested.
