Patent Affairs in HK

* Standard Patent

The application for HK standard patent shall be based on a Chinese patent application for invention, UK patent application for invention, European patent application for invention (designated UK) or PCT application designated China. The registration procedures consist of two stages: the first stage is to make a request to record a designated patent application within six months after the date of publication of the designated application. The second stage is to make a request for registration and grant of the designated patent within six months after the date the designated patent was grant .


Necessary documents for recording a patent application in HK (the first stage):

A) An instruction letter;

B) A copy of the designated patent application as published;

C) Name & address of the applicant;

D) Name & address of the inventor;

E) Title of invention;

F) Abstract in both English & Chinese;


For PCT-based application, following documents & information are also required:

G) A copy of the PCT application as published;

H) Front page of the international publication;

I) A copy of the application published by the CPO;

No extension is provided for the deadlines and no Power of Attorney is required.

Necessary documents for registering & granting a designated patent in HK (the second stage):

A) An instruction letter;

B) A notarized copy of patent as published.



* Short-term Patent

Necessary documents for Short-term patent application in HK:

A) AN instruction letter;

B) A specification (including description, claims and drawings);

C) Abstract in both English & Chinese;

D) A search report made by the prescribed Search Authority which may be filed within eleven months after the date of filing;


For PCT-based application, following documents are also required:

E) A copy of PCT application as published;

F) Front page of the international publication;

G) A copy of the international search report;

H) Front page of the Chinese publication of the PCT application, and

I) A copy of the application published by the CPO;



* Patent for Design

Necessary documents for an application for a patent for design in HK:

A) An instruction letter;

B) Name & address of the applicant;

C) A statement for the right of the applicant if the applicant is not the designer; and

D) Drawings (no larger than 210mm x 297mm) of photograph (no larger than 160mm x 160mm)
